Course Overview:
This program examines the fundamental legal concepts that affect the practice of nursing. Given realistic nursing situations, learners apply concepts related to scope of practice, tort, assault, battery, defamation, respondeat superior, duty and scope of duty, libel, slander, false imprisonment, invasion of privacy, liability, negligence, breach of duty, and malpractice. The roles of the state legislatures and state boards of nursing in the regulation of nursing practice are also reviewed. In the post test, learners have an opportunity to demonstrate that they are not "guilty of ignorance of the law."
Course Objectives:
After completion of this learning activity, the learner will be able to:
- define and give examples of the following terms: scope of practice, tort, assault, battery, defamation, respondeat superior, duty, scope of duty, libel, slander, negligence, false imprisonment, invasion of privacy, malpractice, liability, breach of duty.
- explain the role of the state legislature and the state board of nursing in the regulation of nursing practice..
- explain the relationship between negligence and malpractice.
