Course Overview:
This program will help nurses become aware of their role in witnessing legal documents for clients, including: informed consents, advance directives, living wills, health care proxies, refusal of treatments, discharges against medical advice (AMA), do not resuscitate requests, and incident reports. The importance of proper documentation and following legal requirements, as well as health care facility policy and procedure, are stressed. Learners must think critically in various scenarios to legally and ethically safeguard the client, the health care facility, and themselves as decisions are made about all implications of the nurse's signature.
Course Objectives:
After completion of this learning activity, the learner will be able to:
- discuss general guidelines for witnessing documents.
- explain the basic elements in informed consent, advance directives, DNR, refusal of treatment, discharge AMA, reporting incidents.
- explain the key points in nursing documentation related to each of the situations listed above.
- choose legally appropriate actions when witnessing each of the documents listed above.
- discuss situations in which a client may not have the capacity to accept or refuse treatment.
- identify situations that are exceptions to the duty to disclose.
- describe the duty inposed upon health care agencies by the Patient Self Determination Act.
- compare and contrast types of advance directives.
- discuss prerequisites for DNR or No Code order.
